Safety and Apparel Ltd is committed to the observance of all laws and the highest ethical standards. Compliance with the Consumer Guarantees Act 1993 (the Act) and New Zealand and Australian Standards and /or equivalents is a critical element of this commitment. The Directors have confirmed Safety and Apparel Ltd's commitment to trade practices compliance by approving and issuing this policy.

References in this policy apply to all Safety and Apparel Ltd’s personnel including directors, employees, contractors and consultants who act for us within all sectors, regions, areas, and functions.
What does this policy cover?
This policy is designed to facilitate Safety and Apparel Ltd.’s compliance with its legal and regulatory obligations under the Act. This policy also ensures the maintenance of a high standard of operations and Safety and Apparel Ltd.’s reputation as a good corporate citizen. The purpose of the Act is to enhance the welfare of New Zealanders through the promotion of competition, fair trading, and the provision for consumer protection. The Act regulates how persons conduct business and deals with almost all aspects of the marketplace, including the relationships between suppliers, wholesalers, retailers, competitors, and customers. It does this by prohibiting specific types of conduct such as:
- Misleading or deceptive conduct and false or misleading representations about goods or services;
- Supplying goods that do not comply with mandatory safety or information standards that apply under the New Zealand Consumer Law;
- Engaging in specific types of restrictive trade practices (e.g. anti-competitive agreements; price fixing; boycotts; resale price maintenance; third line forcing and misuse of market power).
What is our strategy for ensuring compliance?
Safety and Apparel Ltd’s commitment to ensuring it meets all of its obligations under the Act includes the development, implantation and maintenance of a trade practices compliance program designed to:
- Prevent, identify and rectify any potential contraventions of the Act;
- Ensure awareness of Safety and Apparel Ltd’s responsibilities and obligations in relation to relevant provisions of the Act;
- Be consistent with the Australian Standard on Compliance Programs (AS3806: 2006), subject to being tailored to Safety and Apparel Ltd’s circumstances;
- Assist Safety and Apparel Ltd to continue to be a good corporate citizen. Safety and Apparel Ltd strives to be an organisation where our people demonstrate commitment to trade practices compliance;
- We have useful systems and procedures to support and assist us to comply with the Act;
- We provide interesting, effective and ongoing training on our responsibilities and obligations arising under the Act;
- Our personnel are held accountable for their performance and their conduct.
What is expected of you?
Safety and Apparel Ltd is committed to providing our teams appropriate resources by way of systems, training and support to enable them to meet their obligations and avoid liability and loss to themselves and the business. Safety and Apparel Ltd personnel are required to comply with all aspects of our Trade Practices Compliance Program and make proper use of the systems, training, and support provided by the business to meet their legal obligations and avoid liability and loss to Safety and Apparel Ltd and themselves. All Safety and Apparel Ltd personnel must observe the spirit and the letter of the law and exercise high standards of ethical conduct when acting on behalf of Safety and Apparel Ltd or performing any duties for Safety and Apparel Ltd.
Companies and individuals that engage in conduct in contravention of the Act even if those contraventions are innocent or unintentional, may be exposing themselves to penalties and fines, damages, Court orders and other serious consequences. Safety and Apparel Ltd will take action internally against any persons who are knowingly or recklessly concerned in a contravention of the Act and will not indemnify them. Deliberate non-compliance with the Act will not be tolerated and may result in dismissal. Safety and Apparel Ltd will not act to the detriment of any employee as a consequence of them raising with management in good faith any breach of law or any violation of Safety and Apparel Ltd’s principles or values or any other legal or ethical concerns.
